These terms govern your use of DiggaByte Labs templates, services, and documentation. By accessing or using our products, you agree to these terms.
1. License and Usage Rights
Template License: When you purchase or download a template from DiggaByte Labs, you receive a license to use that template in your projects and client work. This license is non-exclusive and non-transferable.
Permitted Uses: You may use templates to build applications for yourself, your clients, or your business. You may modify, customize, and extend templates to fit your needs. You may use templates in commercial projects.
Restrictions: You may not resell, redistribute, or share templates in their original or modified form as standalone products. You may not create derivative template products for sale. You may not remove copyright notices or attribution.
Ownership: Templates remain the intellectual property of DiggaByte Labs. You own the applications you build using our templates, but not the template code itself.
2. Payments and Subscriptions
Payment Processing: All payments are processed securely through Stripe. By making a purchase, you agree to Stripe's terms of service. We do not store your credit card information.
Pricing: Prices are displayed in USD and may change at any time. Price changes do not affect active subscriptions until renewal. Taxes may apply based on your location.
Subscriptions: Paid subscriptions automatically renew unless cancelled. You can cancel your subscription at any time through your account settings or by contacting support. Cancellation takes effect at the end of the current billing period.
Refunds: Refunds are handled on a case-by-case basis. Generally, we offer refunds within 30 days of purchase if you are unable to use the template due to technical issues we cannot resolve. Refunds are not available for change of mind or if you have successfully downloaded and used the template.
3. Warranties and Liability
"As Is" Basis: Templates are provided "as is" without warranties of any kind, either express or implied. While we strive for production readiness, we cannot guarantee that templates will be free of errors, bugs, or security vulnerabilities.
Your Responsibility: You are responsible for testing, validating, and securing any application built using our templates. You must ensure compliance with applicable laws, regulations, and industry standards (including GDPR, HIPAA, PCI-DSS, etc.) where applicable.
Limitation of Liability: To the maximum extent permitted by law, DiggaByte Labs shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of our templates.
Maximum Liability: Our total liability for any claims arising from your use of our service shall not exceed the amount you paid us in the 12 months preceding the claim.
4. Support and Updates
Email Support: All customers receive email support at support@diggabyte.com. We aim to respond within one business day. Priority response times apply to paid plan subscribers.
Scope of Support: Support includes help with template installation, configuration, deployment, and troubleshooting. We do not provide custom development services as part of standard support, though we may offer these as separate paid engagements.
Updates: We regularly update templates to fix bugs, address security issues, and add features. Updates are available to all customers who have purchased or subscribed to the template. We do not guarantee backward compatibility with previous versions.
Documentation: Comprehensive documentation is provided with each template. We strive to keep documentation accurate and up-to-date, but we cannot guarantee it will cover every use case or edge case.
5. Prohibited Uses
You agree not to use our templates or services to:
- •Violate any applicable laws, regulations, or third-party rights
- •Build applications that facilitate illegal activities, fraud, or harm
- •Reverse engineer, decompile, or disassemble template code to extract proprietary algorithms or patterns
- •Use templates to compete directly with DiggaByte Labs by creating similar template products
- •Share account credentials or allow unauthorized access to your account
6. Account Security
Account Responsibility: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
Security Breaches: If you suspect unauthorized access to your account, you must notify us immediately at support@diggabyte.com. We are not liable for any loss or damage arising from unauthorized use of your account.
Account Termination: We reserve the right to suspend or terminate accounts that violate these terms, engage in fraudulent activity, or abuse our service.
7. Intellectual Property
Our Property: All templates, documentation, website content, logos, and trademarks are the intellectual property of DiggaByte Labs and are protected by copyright, trademark, and other intellectual property laws.
Third-Party Components: Templates may include third-party open-source libraries and components. These are subject to their respective licenses, which are typically included in the template documentation.
Feedback: Any feedback, suggestions, or ideas you provide about our templates or services may be used by us without obligation to you.
8. Changes to Terms
We may modify these terms at any time. Material changes will be communicated via email or through a notice on our website. Continued use of our service after changes constitutes acceptance of the new terms. If you do not agree to the modified terms, you must stop using our service and may cancel your subscription.
9. Dispute Resolution
Governing Law: These terms are governed by the laws of the jurisdiction in which DiggaByte Labs operates, without regard to conflict of law principles.
Dispute Resolution: Any disputes arising from these terms or your use of our service shall be resolved through binding arbitration in accordance with applicable arbitration rules, except where prohibited by law.
